ACCEPTANCE OF TERMS

This Agreement contains the complete terms and conditions that apply to your participation on our site. If you wish to use the site including its tools and services please read these terms of use carefully. By accessing this site or using any part of the site or any content or services hereof, you agree to become bound by these terms and conditions. If you do not agree to all the terms and conditions, then you may not access the site or use the content or any services in the site.

MODIFICATIONS OF TERMS OF USE

Amendments to this agreement can be made and effected by us from time to time without specific notice to your end. Agreement posted on the Site reflects the latest agreement and you should carefully review the same before you use our site.

USE OF THE SITE

You are prohibited to do the following acts, (a) posting of an items in inappropriate category or areas on our sites and services; (b) collecting information about users’ personal information; (c) maneuvering the price of any item or interfere with other users’ listings; (d) post false, inaccurate, misleading, defamatory, or libelous content.

REGISTRATION AND PAYMENT INFORMATION

By booking with EndGame you are automatically added to our database. You may unsubscribe from our database at any time.

All information you provide, including credit card information must be accurate and up to date. We will not share or pass on your information to any third party. Your credit card information is protected by our merchant services. Our merchant service partners are members of the BBB (Better Business Bureau) Online Reliability Program and follows all guidelines both in letter and spirit.

The team contact (person who registers) must qualify that you are 18 years or older and must be responsible for keeping your password secure and be responsible for all activities and contents that are uploaded under your account. You must not transmit any worms or viruses or any code of a destructive nature. Any information provided by you or gathered by the site or third parties during any visit to the site shall be subject to the terms of endgameproductions.net

TERM

This Agreement will remain in full force and effect while you use the Website and even after you use the site.

LINKS & FRAMINGS

Illegal and/or unauthorized uses of the Services, including unauthorized framing of or linking to the Sites will be investigated, and appropriate legal action may be taken. Some links, however, are welcome to the site and you are allowed to establish hyperlink appropriately. You must immediately stop providing any links to the site on written notice from us.

WARRANTY DISCLAIMER AND EXCLUSIONS / LIMITATIONS OF LIABILITY

We make no express or implied warranties or representations with respect to the Program or any products sold through the Program. In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. We may change the site or any part of it at anytime. The information, content and services on the site are provided on an “as is” basis. When you use the site and or participate therein, you understand and agree that you participate at your own risk.


CONFIDENTIALITY

You agree not to disclose information you obtain from us and or from our clients, advertisers, suppliers and forum members. All information submitted to by an end-user customer pursuant to a Program is proprietary information of endgameproductions.net. Such customer information is confidential and may not be disclosed. Publisher agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.

WAIVER

Failure of endgameproductions.net to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that the we may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.

INCLEMENT WEATHER POLICY

EndGame will do everything possible to ensure filming of your games. We would like to believe that if the game is being played, then it should be filmed. However, where extraordinary circumstances warrant, due to weather, EndGame reserves the right to make the final judgement on whether or not to film a game. We cannot risk injury, equipment being damaged and more importantly we do not want to compromise the quality of your game footage. If a game is determined to not be filmed, the customer will retain their game film credit or opt for a refund.

REFUND POLICY

EndGame has a no refund policy unless the game was not filmed and cannot be rescheduled. If this is the case, the remaining game credits or purchase amount will be returned to the customer. EndGame will do everything in it’s capability to provide a high quality service to its customers.

In the event that tournament games are cancelled and game credits are not possible due to geographic location, a 70% refund will be given back to the customer.

REFUND POLICY FOR PARTIAL FILM MISSING

In the event some or parts of a game’s footage is missing the following amounts will be refunded or discounted from a future purchase:

If 5-15 mins missing, 15% refund or 20% off next order.
If more than 15 mins missing, 50% refund or full game credit.

WEATHER CONDITIONS
EndGame reserves the right to film at any elevation deemed safe in accordance with the forecasted and current weather conditions.


CANCELLATION OF GAMES

If games are canceled, the team contact must communicate this immediately with EndGame via email or phone at a minimum of 24 hours notice. If a game cancelation is not communicated in a timely manner (24 hour ahead minimum) to EndGame and a camera operator arrives on site, no refund is eligible.

UPLOAD OF GAMES TO WEBSITE

In most cases regular season games will be uploaded to our website for viewing and streaming in less than 2 business days. Tournament games will be uploaded to our website for viewing and streaming in less than 5 business days. In certain circumstances where this is not possible EndGame will do its best to upload the games as quickly as possible. Tournament highlight reels will be edited, uploaded and available within 14-21 business days following the final day of the tournament.

Season games will be uploaded for viewing in less than 48 hours. In certain circumstances where this is not possible EndGame will do its best to upload the games as quickly as possible. Season highlight reels will be edited, uploaded and available within 14 business days.

LIVESTREAMING
The quality of a webcast is dependent on the strength of the cell phone coverage or WiFi link at the match site. If the coverage is poor, or if there is a large amount of cell phone traffic at the time of the match, the quality of the webcast may be severely degraded.

ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the substantive laws of Florida, without any reference to conflict-of-laws principles. The Agreement describes and encompasses the entire agreement between the customer, and us and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Agreement.

EndGame Productions, LLC and its affiliates ("we" or "us") respects your privacy and is committed to protecting the identity of visitors to the EndGame website (the “Website”) whether such visitors: (1) simply browse the Website without registering (each, a “Guest”); or (2) register (a “User”) to use one of the various “User” accounts. The terms “you”, “your”, and “user” refer to a Guest and Account Holder. This Privacy Policy describes how we handle the information that we collect about and/or from you and your interaction with the Website each time you visit. This Privacy Policy further explains, in general, what Personal Information and other information is collected on our Website, how the information is used and with whom we may share such information.

BY USING THE WEBSITE, EITHER AS A GUEST OR REGISTERED USER, YOU SIGNIFY THAT YOU HAVE READ, UNDERSTOOD AND CONSENT TO THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY AND OUR TERMS AND THAT YOU GIVE US YOUR CONSENT TO COLLECT, PROCESS, USE, STORE, AND DISCLOSE PERSONAL INFORMATION THAT YOU SUBMIT OR CONVEY THROUGH YOUR USE OF THIS WEBSITE, IN ACCORDANCE WITH THIS PRIVACY POLICY.

1. ABOUT THIS PRIVACY POLICY
This Privacy Policy is only applicable to the Website and not to any other websites that you may be able to access from the Website (whether through an advertisement, service, or content link) or any website of EndGame’s partners, if any, each of which may have data collection, storage, and use practices and policies that may differ materially from this Privacy Policy.

2. INFORMATION WE COLLECT ABOUT YOU
We collect information about you so we can improve our Services and enhance your experience. Any of the below activities with regard to the collection of Website usage information may be performed on our behalf by our service providers, including, for example, our analytics vendors, if any, and our email management partners, if any. When analyzed, Website usage information helps us determine how visitors arrive at the Website, what type of content is most popular, and what type of visitors are interested in particular kinds of content and advertising.

While you may access some of the EndGame Services without registration, many of the content and Services available on the Website require registration. If you choose to register with our Website, we may require you to submit certain information personally identifying you, including your first and last name, title, home address, date of birth, jersey number, affiliated educational institution, affiliated sports team, e-mail address, username and password (collectively, “Personal Information”). “Personal Information” also includes “Personal Data” as well as “Athletic Information”.

We may also ask you for account information we may require from time to time or for the purpose of authenticating yourself or your account if we have reason to believe, in our sole discretion, that you may be violating the Terms or for any other reason we deem necessary. You are responsible for ensuring the accuracy of the Personal Information you submit to EndGame. You can see, review and change your Personal Information by logging into your account and accessing the Account Settings link on the Website. Inaccurate information will affect the information you receive when using our Website and our ability to contact you as described in this Privacy Policy.

Even if you do not register with EndGame, we collect information other than Personal Information, as detailed below (“Non-Personal Information”), about your use of our Website.

(a) Cookies and Other Technologies.
We may utilize cookies and other technologies, such as, web beacons (also known as “clear gifs” and “pixel tags”) to recognize you, customize your experience, and provide advertisements. Cookies are small files placed on your computer, and they allow us to count the number of visitors to the Website and distinguish repeat visitors from new visitors. They also allow us to save user preferences and track user trends. For example, cookies allow us to save your log-in information so you do not have to re-enter it every time you visit our Website. We do not link cookies or web beacons to any Personal Information. We may also enable advertisers and ad servers to promote third party products and/or services by placing advertisements on the Website. These advertisers and ad servers may use cookies and/or web beacons to monitor information related to advertisements. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by EndGame and does not cover the use of cookies by any advertisers. Most web browsers automatically accept cookies, but you do not have to accept them. To disable cookies, you should access the "help" tab on your browser or read the information that came with your browser software. However, your visit to our Website will be enhanced if cookies are not disabled.

(b) Information Collected Automatically.
We automatically receive and collect information from or about the computers, phones, or other devices where you install or access our Services, depending on the permissions you’ve granted, such as IP address or other similar unique device identifier, the URLs of websites you arrive at the Website from or leave the Website to go to, your type of browser and language, access times, the content of any undeleted cookies that your browser previously accepted from us, your operating system, your mobile provider, your mobile device, and your ISP. We may use such information to better understand how EndGame users use our Services, to analyze trends, administer the Website, prevent fraud, and gather broad demographic information, such as country of origin. We may link this information with your Personal Information.
This Website uses Google Analytics to help us understand how users find and interact with the site. We never share any information we obtain from Google Analytics with any third parties for advertising or any other purpose unless compelled to do so by valid legal process. Google Analytics uses cookies to identify your computer by its Internet Protocol (IP) address.

(c) Things you do and information you provide.
We collect the content and other information you provide when you use our Services, including when you sign up for an account, create, share, message or otherwise communicate with others. This can include information in or about the content you provide, such as the location of a photo or the date a video was created. We also collect information about how you use our Services, such as the content you view or engage with or the frequency and duration of your activities.

(d) Things others do and information they provide.
We collect content and information that other people provide or otherwise obtain when they use our Services, including information about you, such as when add you to a roster/team, send a message to you, or upload, sync or import information about you.

(e) Your networks and connections.
We collect information about the people and groups you are connected to or otherwise affiliated with and how you interact with them, such as the people you communicate with the most or the groups you like to share with. We also collect contact information you provide if you upload, sync or import this information from a device.

(f) Information about payments.
If you use our Services for purchases or financial transactions, we collect information about the purchase or transaction. This includes your payment information, such as your credit or debit card number and other card information, and other account and authentication information, as well as billing, shipping and contact details.

(g) Device information.
We collect information from and about the computers, phones, or other devices where you install or access our Services, depending on the permissions you’ve granted. We may associate the information we collect from your different devices, which helps us provide consistent Services across your devices.

(h) Information from websites and apps that use our Services.
We collect information when you visit or use third-party websites and apps that use our Services. This includes information about the websites and apps you visit, your use of our Services on those websites and apps, as well as information the developer or publisher of the app or website provides to you or us.

(i) Information from third-party partners.
We may receive information about you and your activities on and off the Website from third-party partners, such as information from a partner when we jointly offer services or from an advertiser about your experiences or interactions with them.

3. ENDGAME’S USE OF YOUR INFORMATION
We are passionate about creating engaging experiences for people. We use all of the information we have to help us provide and support our Services. Here’s how:

(a) Provide, improve and develop Services.
We are able to deliver our Services, personalize content, and make suggestions for you by using this information to understand how you use and interact with our Services and the people or things you are connected to and interested in on and off our Services.
We conduct surveys and research, test features in development, and analyze the information we have to evaluate, customize and improve products and Services, develop new products or features, and conduct audits and troubleshooting activities.

(b) Communicate with you.
We use your information to send you marketing communications, communicate with you about our Services, updates, promotional offers, and let you know about our policies and Terms. We also use your information to respond to you when you contact us, to provide customer support, and prevent potentially prohibited or illegal activities. We use the information we have to improve our advertising and measurement systems so we can show you relevant ads on and off our Services and measure the effectiveness and reach of ads and Services.

(d) Promote safety and security.
We use the information we have to help verify accounts and activity, and to promote safety and security on and off of our Services, such as by investigating suspicious activity or violations of our Terms or policies. We work hard to protect your account using teams of engineers, automated systems, and advanced technology such as encryption and machine learning.

The information we collect is stored on a secure, password-protected server and only authorized personnel have access to your information. EndGame uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Website and EndGame owns the code, databases and all rights therein.

We use industry-standard encryption technologies with respect to the receipt and transfer of Personal Information you submit. Nevertheless, despite our best efforts, no transmission over the internet and no data storage method can be guaranteed to be safe 100% of the time. EndGame cannot guarantee that your end user data stored on our servers may not be accessed, disclosed, altered, or destroyed by breach of any of our industry standard physical, technical, or managerial safeguards. When you enter sensitive information (such as a credit card number) we encrypt such information using secure socket layer technology (SSL). The EndGame Website and software is hosted on servers in the United States. By using the Website, you consent to the transfer and storage of your information (including your Personal Information) in the United States and its use in accordance with the purposes for which it was originally collected.

Your password is the key to your account. We urge to you to use unique numbers, letters and special characters, and to keep your password secure. We recommend that you exit from your account at the end of each session, especially where you are accessing the Website on a public computer. Immediately notify EndGame of any unauthorized use of your password or account or any other breach of security. It is your sole responsibility to control the dissemination and use of your password, control access to and use of your account, and notify EndGame if/when you desire to cancel your account on this Website. We are not responsible or liable for any loss or damage arising from your failure to comply with this or any other provision.

EndGame will never request your password via email. If you receive an email or other correspondence requesting that you provide any sensitive information (including your Website password or credit card information) via email or to a Website that does not seem to be affiliated with our Website, or that otherwise seems suspicious to you, please do not provide such information, and report such request to us.

In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we will endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your email address, we may notify you by email. You consent to our use of email as a means of such notification.

(e) Create EndGame Content
We may use the information to create EndGame Content, which may include all or part of your Filmed, Edited, or Posted Content, and which may then be posted on any EndGame Website, social media page or on such third party sites for promotional, instructional or other editorial purposes as described in our Terms.
You specifically acknowledge that we have the right to publish all or part of your Posted Content (which may contain your Personal Information) to any EndGame Website or EndGame social media page or on such third party sites for such promotional, instructional or other editorial purposes as described in our Terms.

4. DISCLOSURE OF YOUR INFORMATION
We share certain categories of information we collect from you in the ways described in this Privacy Policy. EndGame may share certain information to website providers under contract who help with our business operations, including, without limitation, our employees, customer-support personnel, credit card processing companies (if you purchase anything the through the Website), and vendors that assist us in processing information or delivering items that you order (collectively “Vendors”) Vendors are governed by obligations to protect the confidentiality and security of such information. These Vendors are restricted from using the information for any purpose other than helping us to provide products these Services.

EndGame may disclose your Personal Information, Non-Personal Information and any and all analytics and other data EndGame produces from your Posted Content to recruiters, coaches, accredited colleges and universities that you have indicated you are interested in attending, as well as other accredited colleges and universities that EndGame and/or third party service providers that have entered into a business relationship with EndGame believe may be of interest to you.

We may also disclose aggregate statistics regarding user behavior as a measure of interest in, and use of, our Website in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.
We reserve the right transfer information about you to another company in connection with a reorganization, merger, sale, acquisition or liquidation involving all or part of EndGame.

We reserve the right to disclose your Personal Information and other personally identifiable information as required by law or to comply with a judicial proceeding, court order, or other legal process. We may also disclose user information as necessary to enforce the Terms, in connection with investigations, or when we believe disclosure is necessarily incident to the provision of our Services or to the protection of the rights, property or safety of EndGame or others.

Additionally, EndGame is a global enterprise, with affiliates worldwide. When you give your Personal Information to EndGame, it may be processed by EndGame in all countries in which EndGame has affiliates. Each of these countries has different privacy laws that afford varying levels of protection for your Personal Information. Regardless of the laws in place in these countries, EndGame will treat the privacy of your information in accordance with this Privacy Policy. By using this Website and/or providing us with your Personal Information, you (i) consent to the transfer, processing and/or storage of any Personal Information you provide, (ii) acknowledge that U.S. law provides a lower standard of protection for personal data than the laws of various countries including, but not limited to, the European Union and (iii) understand that the Website will collect, transfer to, process and/or store and deal with your Personal Information in accordance with this Privacy Policy and U.S. law. Consequently, you waive any claims that may arise under the laws and regulations that apply to you in or of any other country or jurisdiction.

ENDGAME SHALL HAVE NO LIABILITY FOR DISCLOSURE OF INFORMATION OBTAINED DUE TO ERRORS IN TRANSMISSION OR THE UNAUTHORIZED INTERVENTION OF THIRD PARTIES. FURTHER, IF YOU POST ANY OF YOUR PERSONAL INFORMATION IN PUBLIC AREAS OF THE WEBSITE, SUCH AS MESSAGE BOARDS, AND OTHER PUBLIC FORUMS, SUCH INFORMATION MAY BE COLLECTED AND USED BY OTHERS OVER WHOM WE HAVE NO CONTROL. WE ARE NOT RESPONSIBLE FOR THE USE MADE BY THIRD PARTIES OF INFORMATION YOU POST OR OTHERWISE MAKE AVAILABLE IN PUBLIC AREAS OF THE WEBSITE.

5. DEACTIVATING ACCOUNT/OPT-OUT
Upon your request, or in the event we terminate your account in accordance with our Terms, we will deactivate your registered account within ten (10) days of EndGame’s receipt of such request. We may retain Personal Information, Posted Content and any other data produced by EndGame therefrom, from closed accounts to the extent necessary to comply with applicable law, prevent fraud, assist with any investigations, enforce our Terms, take actions we deem necessary to protect the integrity of the Website or our users, or as otherwise permitted by law.

You have the right to "opt in" and "opt out" of certain of our uses of your Personal Information and may change your preferences regarding such uses at any time. For example, we may use your email for transactional and promotional purposes. Emails we send you may contain code that enables our database to track your usage of the emails we send you, such usage includes whether the email was opened and what links (if any) were clicked. If you do not want your Personal Information to be used for marketing purposes, you may write to us at info@EndGame.net.

If you no longer wish to receive emails, you may opt-out of receiving them by following the instructions included in each email, or by emailing us at info@EndGame.net. However, we reserve the right to send you certain service announcements and administrative messages, without offering you an opportunity to opt out. In the case of an important message from us regarding your content, Posted Content, modifications to the Website, our Terms or this Privacy Policy, we reserve the right to contact you by email.

6. CONSENT AND RELEASE

By booking to be filmed by EndGame, the Video/Photographed Party grants permission to use photo, video, or other image of the Party as more fully set forth in this Consent and Release. The Video/Photographed Party hereby grants to EndGame, its agents, employees, independent contractors, licensees, and successors in interest (collectively, the “Released Party”) all ownership rights and the perpetual, absolute, and irrevocable right and permission to copyright, use, and publish the photographed or recorded likeness of the Video/Photographed Party (the “Likeness”) that has been, or is being, obtained pursuant to this Consent and Release. The Video/Photographed Party acknowledges and agrees that there will be no financial or other remuneration in exchange for this grant of ownership rights to my Likeness.

 

The Video/Photographed Party represents and warrants that (i) no other party has been granted  an exclusive license with respect to the Likeness, and (ii) no other party’s authorization or consent is required with respect to the permission granted to the Released Party under this Consent and Release, except that (iii) if the Video/Photographed Party is a minor under the age of 18, the Photographed Party’s parent or legal guardian authorizes EndGame exclusive license with respect to the Likeness and executes this Consent and Release on behalf of the Video/Photographed Party.   

The Photographed Party waives any right that (s)he may have to inspect or approve the Released Party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness.  The Video/Photographed Party and her/his heirs, executors, administrators, and assigns hereby releases the Released Party, its agents, employees, independent contractors, licensees and successors in interest from any and all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Likeness (collectively “Claims”).  This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Likeness.   

7. CHILDREN
EndGame does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Website. The Website, including content available thereon, is not directed at children under the age of 13. In the event that we learn that we have collected Personal Information from a child under age 13 without parental consent, we will delete that information as quickly as possible.

8. CALIFORNIA RESIDENTS
California Civil Code Section 1798.83 permits residents of the State of California to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. The notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it has been shared, along with their names and addresses. 9. US-EUROPEAN UNION AND US- SWISS SAFE HARBOR
EndGame complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. EndGame has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.

10. CHANGES TO THIS PRIVACY POLICY
We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy so please review it frequently. If we do, then we will notify you here, as well as by posting a notice on our Website and/or by e-mailing you. In all cases, use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
